Abstract

This work addresses responsibility, ethical aspects and the role of health personnel in the commission of crimes due to recklessness in the medical field; It also refers to how health professionals can be considered active subjects in cases of medical malpractice, negligence or errors that result in harm or harm to patients; An analysis is also made on the level of care violation by doctors and the deficiencies; Therefore, different legislation related to the responsibility of the health sector is examined, as well as the corresponding sanctions in case of different existing infractions, in order to guarantee the provision of adequate, safe and competent medical care for all. To develop this research, historical-logical, analysis-synthesis, inductive-deductive, hypothetical-deductive, systemic-structural-functional and phenomenological theoretical methods were used. He also used the comparative law method as specific theoretical methods of research. This work is structured by two chapters, the first chapter is called Doctrinal Theoretical Considerations of the Subjects of Crime and the second chapter is health personnel in Cuba, their criminal intervention.
