Abstract

The mortgage is a real guarantee that is constituted on the goods that are not delivered to the creditor. On the other hand, a ship mortgage is a loan secured by real estate that is applied to ships and vessels. The normative protection of the ship mortgage is related to the foundation of theoretical-normative criteria about this figure in the Cuban legal system. The theoretical level methods used were: historical-logical, analysis-synthesis, abstract-concrete, inductive-deductive, as specific to legal research and hermeneutic. As empirical methods, non-participant or external observation and content analysis. As results, a theoretical-doctrinal analysis related to the mortgage is obtained, making reference to its historical evolution, conceptualizations, requirements, differences and similarities in relation to the pledge, and an analysis of the legal treatment of the relevant aspects of the ship mortgage in the Cuban maritime regulations. The projection that urges lies in evaluating the insufficiencies of the ship mortgage in the Cuban legal regulations to support its adequate treatment and understanding.
