Abstract

The research is based on theoretically and doctrinally substantiating the evolution that due process has had in Cuba. The objective of the research is to identify the current challenges of the implementation of due process in Cuba from the constitutional perspective in order to provide a solution to said conflicts. The main results obtained are useful for people in charge of dispensing justice and putting into practice due process in legal processes where equity and equality predominate. The course work is structured in two chapters, the first chapter dedicated to the theoretical-conceptual analysis of the phenomenon of due process in the constitutional field, from the analysis of is conceptualization, the principles that comprise it, the historical evolution that goes from the world to even be a reference in Cuba and see due process as a fundamental right and the second refers to the exploitation of judicial protection of due process in the Cuban constitutional rights, the current challenges faced by due process and the role that civil society and the media in the protection of due process in Cuba.
